EmoEx Mobile App Terms of Use

Welcome to EmoEx, brought to you by EmoEx Technology Limited, a holistic platform dedicated to supporting your journey towards improved emotional and physical well-being. Available as both a mobile application ("App") and a web-based service ("Website"), EmoEx leverages advanced artificial intelligence (AI) to provide interactive experiences. These experiences are designed to assist you in managing your emotional health and enhancing your physical wellness through AI-driven interactions and content.

By accessing or using the EmoEx App or Website, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you are advised not to use the App or Website.


MEMBERSHIPS AND SUBSCRIPTIONS

 

BECOMING A MEMBER

You may sign up as a registered user of EmoEx Technology (a "Member") free of charge. To become a Member, you must create an account ("Member Account") by submitting your email address and creating a secure password. You are responsible for maintaining the confidentiality of your Member Account and password and for restricting access to your device.

 

USER INFORMATION

In your interaction with EmoEx, you may provide certain personalised information, referred to hereinafter as "User Information". EmoEx may integrate with third-party service providers such as Facebook, Google, or Apple ("Third Party Services") to enhance your experience. We will use, store and disclose User Information in accordance with our Privacy Policy.

 

By using EmoEx, you warrant that:

 

  • You are legally capable of entering into binding contracts.

  • You are at least 16 years of age.

  • All User Information you submit is truthful and accurate.

  • Your use of EmoEx does not violate any applicable law or regulation.

 

PROTECTION OF USER INFORMATION

You are responsible for maintaining the confidentiality of your Member Account, password, and User Information. EmoEx will not be liable for any loss or damage arising from your failure to comply with this Section.

 

SUBSCRIPTIONS

Payment processing for EmoEx Technology will be carried out by third-party payment processors ("Payment Processor") such as AppStore, Google Play and other platforms. Your usage of the Payment Processor is subject to additional terms provided by them.

 

EmoEx Technology offers Memberships in the following ways:

Professional Guidance Experience: Starting at $39.99 NZD/month

 

Unlock the full potential of EmoEx 2.0 with access to our exclusive array of Professional Characters. Each character embodies years of expertise from leading doctors, counsellors, and workplace professionals, brought to life through advanced generative AI technology. This premium feature offers you:

  • All features in the Registered Membership Offerings.

  • Expertise at Your Fingertips: Instantly tap into the wisdom and experience of top professionals across various fields.

 

Subscriptions to our Professional Characters are purchased on a time-limited basis. Subscriptions are subject to automatic renewal unless cancelled prior to the renewal date. You may cancel your Subscription at any time before the Renewal Commencement Date through your Member Account.

 

EmoEx Business

At EmoEx, we understand that the well-being of your employees or members is paramount to the success of your business or organisation. We offer innovative solutions tailored to meet the unique needs of your workforce, ensuring holistic care that encompasses both mental and physical health.

If the user is under the EmoEx Business Program offered by their employer or any other organisation, redeeming the designated Access Code will give them access to that specific character. Any individual subscriptions can be cancelled and refunded to the proportions used in that subscription. Users will need to contact EmoEx via info@emoexai.com.

 

AUTO-RENEWAL AND CANCELLATION THROUGH THIRD-PARTY PAYMENT PROCESSORS

If you have subscribed to a Paid Subscription via a Third-Party Payment Processor, such as Apple's App Store or Google Play, the auto-renewal of your Subscription is managed by that Third-Party Payment Processor. Your Subscription will automatically renew for successive renewal periods equal to the term of the original Subscription unless you cancel it before the auto-renewal date through the Third-Party Payment Processor's platform.

 

To cancel your auto-renewal through a Third-Party Payment Processor, you must follow the cancellation instructions provided by the respective platform. For example, for Subscriptions purchased via Apple's App Store, you would go to 'Settings' on your iOS device, tap 'Apple ID', tap 'Subscriptions', find EmoEx Technology, and then tap 'Cancel Subscription'. Similarly, if purchased via Google Play, you would go to 'Google Play Store', tap 'Menu', then 'Subscriptions', find EmoEx Technology, and tap 'Cancel'.

 

Auto-renewals must be cancelled at least 24 hours before the end of the current subscription period to avoid being charged for the next subscription period. Once cancelled, you will retain access to your Paid Subscription features until the end of the current Subscription period, after which you will be reverted to a Free Member Account.

 

Note: Cancelling a Subscription through a Third-Party Payment Processor does not terminate your Member Account on EmoEx; it only cancels the automatic renewal of your Subscription.


 

FREE TRIALS AND OTHER PROMOTIONS

Certain Subscription offerings may be available on a free trial or other promotional basis. Unless cancelled before the promotion ends, these will automatically convert to a paid Subscription.

 

ETHICAL BOUNDARIES

The App is not a substitute for professional medical or therapeutic advice and does not offer clinical or medical interpretations. It is designed to maintain ethical boundaries and protect user privacy in accordance with our privacy policy.

 

LIMITATION OF LIABILITY

EmoEx Technology shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the App. Please see User Agreement and Disclaimer for details.

 

PRIVACY

Your confidentiality is important to us. Please refer to our Privacy Policy for details on how we protect your information.

 

TERMINATION

We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.

 

CHANGES OF TERMS

We reserve the right to change these Terms at any time. Updated versions of the Terms will be posted in the App and are effective immediately.
